Mobile Messaging Terms & Conditions (SMS/MMS)
Agnsy Inc. provides a mobile messaging program subject to these Mobile Messaging Terms.
Program Name & Description
The Agnsy Real Estate Alerts program allows users to receive SMS/MMS mobile messages by opting-in. Messages regarding the "Agnsy" brand may include service-related alerts, account verification (2FA), property updates, real estate valuation insights, and communication regarding your offers and transactions.
Message Frequency
Message frequency varies based on your account activity and interaction with the platform.
Cost
Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/MMS messages, including charges from your wireless provider.
Opt-Out Instructions
You can cancel the SMS service at any time. Just text "STOP", "CANCEL", "UNSUBSCRIBE", "QUIT", or "END" to the short code or phone number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time by visiting https://www.agnsy.com/opt-in.

Carrier Liability Disclosure
Carriers are not liable for any delayed or undelivered messages.
Privacy & Data Sharing

No Mobile Information Sharing: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Interpretation
Words with initial capital letters have defined meanings under the conditions below. The following definitions apply regardless of whether they appear in singular or plural.

For the purposes of these Terms and Conditions:

Acknowledgment
These Terms govern your use of the Agnsy Service and form a binding agreement between You and the Company. By using the Service, You agree to be bound by these Terms and our Privacy Policy. If You disagree with any part of the Terms, You may not access or use the Service.
You represent that you are over the age of 18 and legally capable of entering into binding contracts. Agnsy does not knowingly allow those under 18 to use the Service.
Overview of the Service
Agnsy is an AI-native, end-to-end real estate platform that enables home buyers to research, evaluate, and purchase residential property using modern automation and real-time analysis tools. Agnsy combines disclosure review, valuation insights, market statistics, and offer generation in a seamless experience.
Some actions within the platform may be executed or supplemented by licensed real estate agents to comply with local regulations.
Real Estate Brokerage Disclaimer
- Not a Substitute for Manual Review: Agnsy generates insights using proprietary AI models to analyze disclosures, valuation data, and market conditions. These outputs are informational in nature and do not replace your obligation to manually review disclosure packages or consult professionals.
- No Legal or Financial Advice: Information on the Agnsy platform is not legal, tax, or financial advice. Always consult your own advisors.
- Transaction Risk: You assume full responsibility for any transaction decisions. Agnsy does not guarantee the success or outcome of any real estate transaction.
- Broker Compliance: Agnsy works with licensed brokers in jurisdictions where required. Human agents may step in where necessary to fulfill legal obligations.
AI Content Disclaimer
Agnsy uses AI to summarize, analyze, and present disclosure documents and other real estate-related data. While we strive for accuracy, AI-generated content may contain errors, omissions, or noncompliant language. You are solely responsible for verifying the accuracy and legality of all materials provided by the platform.
Links to Third-Party Websites
The Service may include links to third-party websites or services. Agnsy has no control over and assumes no responsibility for the content, policies, or practices of any third-party sites or services. Use them at your own risk.
Email and Communication Automation Services
If you use Agnsy's optional automation tools for outbound messaging (e.g. as an agent or brokerage):
- Compliance: You must comply with all applicable laws (e.g., CAN-SPAM, Fair Housing, TCPA).
- Responsibility: You are the legal "sender" of any emails or messages. Agnsy is not liable for the content, delivery, or recipient response.
- Opt-Outs: You must honor unsubscribe requests promptly and include valid sender information in each message.
- Indemnity: You agree to indemnify Agnsy from any legal actions arising from your use of automated outreach tools.
Limitations of Liability
To the fullest extent permitted by law, Agnsy disclaims all liability for:
- Transaction failure or errors resulting from reliance on AI analysis.
- Loss of profits, data, or business resulting from your use of the Service.
- Delays or interruptions to the platform.
Maximum liability for any claim shall not exceed $100 or the amount You paid us in the last 6 months, whichever is greater.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" with no warranties of any kind. We do not guarantee:
- That the Service will be error-free or uninterrupted.
- The accuracy or completeness of content.
- That AI-generated insights will be free of bias, oversight, or misinterpretation.
You use the Service at your own risk.
Return & Refund Policy
Agnsy does not offer refunds. All purchases, subscriptions, or service fees are final.
- Refunds: Not available unless required by law.
- Service Interruptions: Minor or temporary outages do not warrant credit or refunds.
- Termination: We may suspend or terminate access for violations of these Terms.
Termination
We may suspend or permanently terminate your account if:
- You violate these Terms;
- You use the Service in a way that violates applicable law;
- You attempt to manipulate, hack, or bypass Service limitations.
Upon termination, your right to use the Service ceases immediately.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
Dispute Resolution
In the event of a dispute, please contact us first at team@agnsy.com. We'll attempt to resolve issues amicably before resorting to arbitration or litigation.
United States Use Only
Agnsy is intended for users located within the United States. We do not market the Service to residents of the EU or other jurisdictions with additional privacy or consumer protection requirements.
Severability and Waiver
If any part of these Terms is found to be unenforceable, that part will be modified to reflect the original intent as closely as possible, and the rest will remain valid. A failure to enforce any right will not constitute a waiver of that right.
Changes to These Terms
We may update these Terms from time to time. We will notify you of major changes via email or the Service. Continued use of the platform after changes constitutes acceptance.
